§ 1 SCOPEThe terms and conditions apply to contracts for the temporary care of dogs, as well as all services provided by the Lijanas Hundeservice dog boarding facility to the customer during this time.
§ 2 INITIAL CONSULTATION/BOOKING
(1) The dog owner will be informed in detail about the accommodation and keeping of the dog at Lijanas Dog Service during the initial consultation. Details, times, conditions and costs, if necessary with additional costs, are specified in the care contract and after the trial day. (2) Any special features, such as food and medical care, must be specified by the dog owner before accepting the dog. The dog owner ensures that food, collar, leash and vaccination certificate are provided in good time when the dog to be looked after is handed over. If the food is not enough, a surcharge will be charged depending on the amount and type of food. (3) Physical and psychological peculiarities or disorders of the dog to be looked after as well as the suspicion of this, in particular aggressive or anxious behavioral problems, must be reported to the dog boarding facility when booking. (4) The Owner confirms that all information regarding the dog is complete and truthful.
§ 3 CONTRACTUAL PARTNER/CONCLUSION (1) The contractual partners are the Lijanas Hundeservice dog boarding house and the owner/keeper of the dog (hereinafter referred to as the customer). If a third party has ordered for the customer, the third party is liable together with the customer as joint and several debtors to the Lijanas Hundeservice dog boarding facility for all obligations
of the dog care contract, provided there is a corresponding declaration from the third party.
(2) The dog can be registered by email, telephone or What's App. (3) The Lijanas Hundeservice dog boarding kennel confirms the registration to the customer in writing or in person and informs the customer of the costs incurred for the services requested by the customer when registering. (4) The contract between the dog owner/customer of the dog to be looked after by Lijanas Hundeservice is only concluded when Lijanas Hundeservice confirms the reservation to the customer, informs the customer of the costs of the booked services, and a deposit of 50% of the price has been made. (5 ) If no deposit is made by the customer, a contract is not concluded and the reservation is cancelled. (6) If payment is made late, this represents a new offer by the customer. A contract is only concluded in the event of late payment if Lijanas Hundeservice Confirmed to customers that they would take in the dog within the desired time. If care cannot be provided within the desired period, Lijanas Hundeservice undertakes to inform the customer of this within 3 days and to reject the contract offer.
In this case, Lijanas Hundeservice will reimburse the customer for the payment made. (7) Dogs that have not previously been cared for by Lijanas Hundeservice must be registered for a trial day at the dog boarding facility before a stay of several days. A decision will then be made as to whether the dog is physically and mentally stable enough for a longer stay. (8) Registration for day care must be made by 12 p.m. on Saturday before the dog is handed over. A contract is concluded when the Lijanas Hundeservice dog boarding kennel confirms that the dog will be admitted to day care on the desired day. The requested services must be paid for by the customer by the end of the day, or by the end of the week for stays lasting several days. If no payment is made, the Lijanas Hundeservice dog boarding facility is entitled to refuse to accept the dog in the future.
§ 5 SERVICES
(1) Lijanas Hundeservice is obliged to take care of the dog for the time booked in advance upon delivery and to provide the agreed services. (2) The customer is obliged to take care of the dog and the services provided by the customer for the dog The applicable or agreed prices of the Lijanas Hundeservice dog boarding facility must be paid for any other services used. This also applies to services and expenses of the dog boarding house to third parties arranged by the customer. (3) The prices can be changed by the Lijanas Hundeservice dog boarding house if the customer subsequently changes the number of dogs to be looked after, the services of the Lijanas Hundeservice dog boarding house or the duration of care of the dog and the dog boarding Lijanas Hundeservice agrees to this.
§ 6 WALKING / EXERCISE
During the agreed dog boarding period, the Lijanas Hundeservice dog boarding facility ensures that the dog placed in the Lijanas Hundeservice dog boarding facility receives adequately supervised walks. The dog owner agrees that his dog will be kept on a leash and assumes liability for all associated risks. By stating socially acceptable, the dog owner consents to their dog being walked with other dogs.
§ 7 VACCINATIONS, ILLNESSES AND DEATH
(1) When handing over their dog to the Lijanas Hundeservice dog boarding facility, the dog owner assures that it has a valid, current vaccination protection that corresponds to its age. This includes vaccinations against distemper, hepatitis, leptospirosis and parvovirus that are less than a year old and at least 4 weeks old. Vaccinations against kennel cough are not mandatory, but encouraged. The valid, German vaccination certificate with the necessary preventative vaccinations must be presented when the dog to be looked after is handed over and will be deposited at the Lijanas Hundeservice dog boarding facility. (2) If the dog given to the dog boarding facility does not have the vaccinations listed, the Lijanas Hundeservice dog boarding facility is entitled to to withdraw from the dog boarding contract or to get the vaccinations plus an expense allowance of 50 euros (see § 13) at the dog owner's expense. Any consequential damage caused by contractually guaranteed vaccinations will be borne by the dog owner. The Lijanas Hundeservice dog boarding facility assumes no liability for this and excludes any compensation for this. (3) When handing over his dog to the Lijanas Hundeservice dog boarding facility, the dog owner also insures that:
that it is healthy and free of parasites and infectious diseases for other people or animals and has received spot on tick/flea prophylaxis or a tick/collar within the last 4 weeks and has been dewormed against tapeworms and roundworms in the last 3 months . This must be proven by confirmation from a veterinarian. Otherwise, the Lijanas Hundeservice dog boarding facility reserves the right to treat the dog with the appropriate means for a fee plus an expense allowance of €50 (see § 13). Any consequential damage caused by contractually guaranteed prophylactic measures will be borne by the dog owner. The Lijanas Hundeservice dog boarding facility assumes no liability for this and excludes any compensation for this. (4) The dog owner expressly discloses any suspicion of illness or knowledge of a chronic illness or disability of the dog to be cared for and any existing therapies when booking admit. The Lijanas Hundeservice dog boarding facility assumes no liability for sick dogs and their consequences. If the dog brings a contagious disease or a parasite infestation, the owner of this dog bears the resulting costs, such as disinfection and co-treatment of infected dogs and people or other animals. Despite all prophylaxis, infection with parasites can occur in exceptional cases. In this case, the Lijanas Hundeservice dog boarding facility cannot accept any liability. (5) The Lijanas Hundeservice dog boarding facility does not guarantee the health of the dog to be looked after. The dog owner agrees that all efforts, regardless of the costs, should be carried out by a veterinarian or other third parties in the event of illness or its clarification or in the event of an accident/injury to his dog. The Lijanas Hundeservice dog boarding house is entitled to commission a veterinarian or third party of its own choice to carry out the treatment. The resulting costs will be covered in full
taken over by the dog owner. (6) If a dog dies due to illness or accident etc., no compensation can be claimed, with the exception of intent or gross negligence. If requested, the Lijanas Hundeservice dog boarding facility will commission a veterinarian of the dog owner's choice to determine the cause of death. The resulting costs are borne entirely by the dog owner.
§ 8 BITCHES IN heat Female dogs in heat can only be taken in for an additional cost and not during standing days. If the dog owner gives a female dog in heat to the dog boarding kennel or a female dog that comes into heat during the stay and does not disclose this to the Lijanas Hundeservice dog boarding kennel, no liability will be accepted for the resulting consequences (coverage of the female dog during the dog boarding period). The resulting costs are borne solely by the dog owner.
§ 9 LIABILITY
(1) The dog owner assures that the dog being cared for is his property and that there is legally valid liability insurance. The insurance number and the name of the insurance company must be provided upon delivery. (2) The dog is accepted into the care of the Lijanas Hundeservice dog boarding facility at the dog owner's own risk. The dog owner is liable for personal injury, property damage or financial damage caused by the dog being cared for. (3) The liability of the Lijanas Hundeservice dog boarding house is for claims for damages and for each individual case of damage in accordance with the Lijanas Hundeservice dog boarding company's business liability insurance
Limited to 100,000 euros. If there is no insurance cover in the individual case of damage, liability is limited to 10,000 euros. Liability for damages resulting from injury to life, body or health that are based on an intentional or negligent breach of duty by the owner of the Lijanas Hundepension dog boarding facility or his vicarious agents and/or for other damages that are based on an intentional or grossly negligent breach of duty by the dog boarding facility Lijanas Hundeservice or its vicarious agents remain excluded from this. (4) The Lijanas Hundeservice dog boarding facility assumes no liability for the dog owner's own items such as baskets, blankets, boxes, toys, leashes, etc.
§ 10 EARLY COLLECTION
The dog owner is obliged to name a contact person who can reach the Lijanas Hundeservice dog boarding facility at any time. The dog owner or the contact person will be notified immediately by the Lijanas Hundeservice dog boarding facility if their dog develops health or psychological problems or if the dog shows adjustment problems that exceed the usual level. You will also be notified if the dog to be cared for at the Lijanas Hundeservice dog boarding facility shows aggressive behavior or fearful behavior that makes safe management impossible. The dog owner
In these cases, the dog must be ensured that the dog is picked up by him or the contact person if necessary.
§ 11 NON-COLLECTION/ANIMAL SHELTER
The dog owner undertakes to pick up the dog given to the dog boarding facility immediately after the agreed dog boarding period has expired. If the dog is not picked up, it will be taken to an animal shelter chosen by the dog boarding facility after 14 days. The costs incurred in this context will be billed to the dog owner. Until then, the contract is automatically extended by 14 days on the agreed collection day. The respective daily rate must be paid for each additional day. The Lijanas Hundeservice dog boarding facility reserves the right to accommodate the dog elsewhere if the dog boarding facility is full after the agreed care time.
§ 12 DRIVE-OFF AND PICK-UP TIMES
(1) The pick-up times can be agreed individually and, if possible, with the Lijanas Hundeservice dog boarding facility and are also within the framework of the existing opening times.
(2) The drop-off times depend on the existing opening times and can be arranged individually and, if possible, with the Lijanas dog service.
§ 13 PRICES
(1) The dog owner undertakes to pay the price in euros specified in the care contract. These are valid until the next change. (2) The dog boarding price is paid in advance and in cash or, by arrangement, by bank transfer to Lijana's dog service account Jacqueline Lingen.
(3) Additional services such as emergency pension, extension of care time, veterinary visits must be paid in cash upon collection. If the payment obligation is not met, the Lijanas Hundeservice dog boarding facility reserves the right to keep the dog until the dog owner pays the set price. The dog owner bears the resulting additional costs.
§ 14 CANCELLATION/REDUCTION OF SERVICE
(1) Reservations made by the contractual partner are binding for both contractual partners. In the event of a cancellation or reduction by the customer, the customer must pay the following compensation per dog and stay:
for dog boarding (=care/overnight stays lasting several days):
a) Compensation of 50% of the value of the services ordered if the booking that has existed for some time is canceled. If the booking is postponed, we will credit 50% of the deposit already received. b) Compensation for damages amounting to 100% of the value of the services ordered if the dog is not placed in care on the agreed delivery date without notification from the customer.
for dog day care/overnight stays:
a) no compensation if the written cancellation or reduction is received by Lijanas Hundeservice more than 48 hours before the agreed delivery dateb) compensation in the amount of 100% of the value of the ordered services if the written cancellation or reduction by Lijanas Hundeservice is received later than 24 hours before the agreed delivery date (2) The customer is entitled to provide proof that the damage to Lijanas Hundeservice did not exist or was less. If Lijanas Hundeservice can otherwise provide the canceled service to third parties within the agreed period, the customer's compensation will be reduced by the amount that these third parties pay for the canceled service, up to a maximum of no more than the entire compensation
§ 15 CUSTOMER DATA
The customer agrees that the personal data and relevant data collected will be included in the customer file. This data is used exclusively for professional animal care and is not passed on to third parties.
§ 16 RIGHT OF REFUSAL
The Lijanas Hundeservice dog boarding facility has the authority to reject inquiries and orders of any kind without giving reasons.
§ 17 FINAL PROVISIONS
The contract language is German. If any provision of these terms and conditions is or becomes illegal or invalid, the remaining terms and conditions remain in effect. The Lijanas Hundeservice dog boarding facility and the customer will replace the invalid provision with an effective one that comes closest to the desired legal and economic result of the contractual partners' agreement. Such a provision is deemed agreed and valid.
